1. ABOUT THESE TERMS

These Terms & Conditions apply to your use of the Boon website and, where applicable, to the purchase of goods and services from Boon.

Throughout these Terms, “Boon”, “we”, “us” and “our” refer to Boon Kitchens & Joinery. “You” and “client” refer to the person purchasing goods or services from us.

Our website and online store are hosted by Shopify, which provides the ecommerce platform through which certain products and services may be offered.

For bespoke kitchens, joinery and other commissioned projects, your contract with us may also include:

  • our quote or proposal;

  • approved drawings and specifications;

  • schedules of works or finishes;

  • written variations;

  • invoices; and

  • any project-specific terms expressly agreed in writing.

Together, these documents form the agreement between you and Boon.

If there is any conflict between these Terms and a project-specific quote, proposal or written agreement, the project-specific document will take precedence in relation to that project.

Nothing in these Terms affects any statutory rights you may have as a consumer.


PART A — KITCHENS, JOINERY & COMMISSIONED PROJECTS

2. QUOTES

Each quote is prepared for the project, property and scope identified within it.

Prices are based on the information available at the time of quoting, including drawings, measurements, design details, material selections and assumptions agreed with you.

Unless expressly stated otherwise, our quotes exclude:

  • appliances;

  • plumbing;

  • electrical work;

  • gas work;

  • tiling;

  • decoration;

  • building or structural works;

  • flooring;

  • waste removal;

  • third-party trades; and

  • anything not specifically listed within the quote.

Quotes are valid for 30 days from the date of issue unless otherwise stated.

We may revise a quote where the scope or information on which it was based changes, including changes to the design, site conditions, measurements, materials, supplier costs, delivery requirements or installation requirements.

Any price variation will be communicated to you before the relevant additional work proceeds wherever reasonably possible.


3. DESIGN PROCESS & APPROVAL

Before production begins, Boon will issue relevant drawings, specifications and/or a written scope for your approval.

By approving these documents, you confirm that you have reviewed and accepted the relevant:

  • design;

  • dimensions;

  • layout;

  • finishes;

  • materials;

  • appliances;

  • fittings and accessories; and

  • exclusions.

It is your responsibility to review approval documents carefully and notify us of any errors or requested changes before approval.

Once a design has been approved, subsequent changes may affect the price, manufacturing programme, lead time and installation date.

We will not normally begin production until the relevant drawings and specifications have been approved and the required production payment has cleared.


4. DEPOSITS & PAYMENT

A deposit may be required to begin design work, reserve production capacity or commission a project.

Unless otherwise stated in your quote, payments may include:

Design deposit

Payable to begin the design and quoting process.

Where expressly stated in your quote, this amount may be deducted from the final project price if the project proceeds.

Production deposit

Payable once the quote, drawings and relevant specifications have been approved.

Payment confirms the order and allows Boon to begin procurement and manufacture.

Balance payment

The remaining balance must be paid before delivery or installation unless otherwise agreed by us in writing.

All payments must have cleared before the relevant project stage can begin.

Any alternative payment schedule will be set out in your quote or agreed separately in writing.


5. BESPOKE & MADE-TO-ORDER GOODS

Many Boon kitchens, furniture pieces and joinery items are designed or manufactured specifically for a particular client, property or specification.

Where goods are genuinely bespoke, personalised or made to your specifications, statutory change-of-mind cancellation rights may not apply.

Once approved bespoke goods have entered procurement or production, you may remain responsible for costs reasonably incurred by Boon as a result of your cancellation, including committed materials, third-party costs, manufacturing work and other losses directly resulting from the cancellation.

Nothing in this section limits your statutory rights where goods are faulty, not as described or otherwise fail to conform to the contract.


6. CHANGES & VARIATIONS

Changes requested after approval must be confirmed in writing.

Changes may result in additional:

  • design fees;

  • materials;

  • supplier costs;

  • manufacturing time;

  • installation labour;

  • delivery charges; or

  • storage costs.

Where reasonably possible, we will confirm additional costs before proceeding.

Where an urgent decision is required on site and you or your authorised representative gives verbal approval, Boon may proceed on that basis and confirm the variation in writing afterwards.


7. MEASUREMENTS

Quotes and preliminary designs may be based on architectural drawings, client-supplied measurements or other early site information.

Final dimensions may need to be checked by Boon before production.

If final site measurements or conditions differ from the information previously provided, we may need to revise the design, specification, price or programme.

Where dimensions or other information have been supplied by you, your architect, contractor or another third party, you are responsible for ensuring that information is accurate unless Boon has expressly agreed to verify it.


8. SITE ACCESS

You are responsible for ensuring reasonable and safe access to the property for surveys, deliveries and installation.

This includes, where relevant:

  • parking and loading access;

  • unloading space;

  • doorways and corridors;

  • stair access;

  • lift access;

  • access restrictions;

  • working hours; and

  • appropriate protection of finished areas.

Please tell us about any known access restrictions before your quote is approved.

Where access differs materially from the information provided and results in additional labour, specialist equipment, redelivery or other costs, those reasonable additional costs may be charged to you.


9. SITE READINESS

The site must be ready for delivery and installation on the dates agreed with Boon.

Depending on the project, this may require:

  • the existing kitchen or joinery to have been removed;

  • relevant building and structural works to be complete;

  • walls, floors and ceilings to be suitably prepared;

  • plumbing, electrical and other services to be in agreed positions;

  • flooring to be completed or otherwise agreed with us;

  • the property to be dry and secure;

  • clear working space to be available; and

  • safe access for our installation team.

Where the site is not ready and this prevents us from carrying out agreed work, the programme may need to be rescheduled.

Reasonable additional storage, redelivery, rescheduling or labour costs resulting from site delays outside Boon's control may be charged to you.


10. DELIVERY

Delivery charges will be identified in your quote unless expressly included within the project price.

You must ensure that the property is accessible and available to receive delivery at the agreed time.

You should inspect delivered items where reasonably possible and tell us promptly about any visible damage.

Where Boon is also responsible for installation, we remain responsible for the goods while they are under our control, subject to applicable law.

Where goods are supplied for installation by you or another contractor, responsibility for them will pass in accordance with the delivery arrangements agreed with you and applicable law.


11. INSTALLATION

Where installation is included, Boon will install the furniture and joinery identified within the quote.

Unless expressly stated otherwise, installation does not include:

  • plumbing;

  • electrical work;

  • gas work;

  • appliance connection;

  • tiling;

  • flooring;

  • decoration;

  • structural work; or

  • making good.

You are responsible for appointing appropriately qualified third-party trades where required.

Installation of fitted furniture can result in minor disturbance to adjacent walls, floors and finishes. Reasonable making good may therefore be required following installation and is not included unless expressly stated in the quote.


12. WORKTOPS & TEMPLATING

Where worktops require templating, this will normally take place after the relevant furniture has been installed.

Lead times for those worktops begin following templating and approval rather than from the date the furniture is installed.

The timing of subsequent worktop installation will depend on the relevant material, fabricator and specification.


13. NATURAL MATERIALS & FINISHES

Boon works with natural and living materials including timber, veneer, stone, marble, metal, glass, lacquer, tile and specialist finishes.

These materials may naturally vary in:

  • colour;

  • grain;

  • figuring;

  • veining;

  • texture;

  • pattern;

  • mineral deposits;

  • knots;

  • movement;

  • tone; and

  • patina.

Samples, photographs and digital renders are indicative and cannot represent every variation within a finished natural material.

Timber and veneer may move slightly as temperature and humidity change.

Stone and marble may contain natural fissures, veins and variations.

Metals and specialist finishes may develop a patina.

Certain surfaces may stain, scratch, etch, mark or change through normal use.

These inherent characteristics are not faults where they are consistent with the reasonable nature and performance of the material.


14. APPLIANCES & THIRD-PARTY PRODUCTS

Appliances, sinks, taps, handles, lighting and other third-party products are included only where expressly listed in your quote.

Third-party products are subject to the manufacturer's applicable warranty in addition to any statutory rights you may have.

Where a problem relates to a third-party product, we will reasonably assist with coordinating the relevant supplier or manufacturer where appropriate.

Boon is not responsible for delays or failures caused solely by third-party suppliers or products where these are outside our reasonable control, but this does not affect any responsibility we have to you under applicable consumer law.


15. PROJECT TIMELINES

We will provide estimated lead times and installation dates in good faith.

Unless expressly agreed otherwise in writing, project dates are estimates rather than guarantees.

Programmes may be affected by circumstances including:

  • client design changes;

  • supplier delays;

  • material availability;

  • site readiness;

  • access issues;

  • third-party trades;

  • delayed approvals; and

  • circumstances outside our reasonable control.

We will tell you about material changes to the programme as soon as reasonably possible.

Nothing in this section removes any statutory rights you may have where goods or services are not supplied within an agreed or legally required timeframe.


16. STORAGE

If furniture or materials are ready but delivery or installation cannot proceed because of circumstances attributable to the client, site conditions or third-party trades, we may arrange storage.

Where storage charges apply, we will tell you the applicable charges in writing.

Reasonable additional redelivery or rescheduling costs may also apply.


17. PRACTICAL COMPLETION & SNAGGING

At the end of installation, Boon will review the project with you where reasonably possible.

Any remaining minor adjustments or snagging items will be recorded and addressed within a reasonable timeframe.

Practical completion means that the kitchen or joinery has been substantially installed and can reasonably be used for its intended purpose. It does not necessarily mean that every minor snagging item has already been completed.


18. WORKMANSHIP & GUARANTEE

Boon stands behind the workmanship and manufacture of its kitchens and joinery.

We will remedy defects arising from faulty manufacture or installation by Boon in accordance with the guarantee provided with your project and your statutory rights.

Our guarantee does not cover problems caused by:

  • normal wear and tear;

  • misuse;

  • accidental damage;

  • failure to follow reasonable care instructions;

  • natural movement or characteristics of materials;

  • inappropriate environmental conditions;

  • staining, etching, scratching or patination resulting from use;

  • unauthorised alterations or repairs; or

  • work carried out by third-party trades.

This guarantee is additional to, and does not replace or restrict, your statutory rights.


19. CARE & MAINTENANCE

You are responsible for the reasonable ongoing care and maintenance of the kitchen, joinery, worktops, finishes and accessories.

Boon may provide care guidance for materials including timber, marble, granite, metal, lacquer, tile, glass and specialist finishes.

Failure to follow reasonable care guidance may affect whether damage is covered by our guarantee where that failure has caused or contributed to the problem.


PART B — ONLINE PRODUCTS & ORDERS

20. ONLINE PRODUCT INFORMATION

We take reasonable care to describe and represent products accurately on our website.

However, colours, textures and finishes may appear differently depending on your screen and device.

Natural materials may also vary from the particular example photographed.

Measurements and dimensions will be stated on individual product pages where relevant.

Nothing in this section affects your rights where a product is materially different from its description.


21. ONLINE ORDERS

Placing an order through our website constitutes an offer to purchase the relevant goods.

After receiving your order, we will send an acknowledgement. A contract is formed when we confirm that your order has been accepted or otherwise begin fulfilment, as specified in our order confirmation.

We may refuse or cancel an order where reasonably necessary, including where:

  • a product is unavailable;

  • there has been an obvious pricing or description error;

  • we cannot authorise payment;

  • delivery is not possible to the requested location; or

  • we reasonably suspect fraud or misuse.

If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled goods.


22. PRICES & VAT

Prices displayed on the website will state whether VAT is included.

For commissioned projects, VAT treatment will be stated on the relevant quote.

Where a reduced rate or exemption is claimed, you are responsible for providing any documentation reasonably required to establish eligibility.

If the information supplied proves incorrect and VAT subsequently becomes legally payable, we may recover the applicable VAT from you to the extent permitted by law.

Delivery and other charges will be identified before purchase or set out in your quote.


23. CANCELLATIONS, RETURNS & REFUNDS

Your cancellation and return rights depend on the nature of the goods or services purchased.

Standard online goods

Where applicable, consumers purchasing standard goods online generally have a statutory right to cancel within the relevant cancellation period.

Details of how to return eligible products and obtain a refund are set out in our Refund & Returns Policy.

Bespoke and personalised goods

The statutory right to cancel for change of mind does not generally apply to goods made to your specifications or clearly personalised.

This may include bespoke kitchens, bespoke joinery, custom furniture and other items genuinely manufactured to an individual specification.

This does not affect your statutory rights where goods are faulty, not as described or otherwise fail to conform to the contract.


PART C — WEBSITE

24. USING OUR WEBSITE

You may use our website for lawful purposes.

You must not:

  • misuse or interfere with the operation or security of the website;

  • introduce malicious software;

  • attempt unauthorised access to our systems;

  • scrape or systematically extract content without permission;

  • use automated tools or agents in a way that materially disrupts the website or circumvents technical restrictions;

  • use our website or content to infringe the rights of another person; or

  • use our website for unlawful or fraudulent purposes.

We may restrict access where reasonably necessary to protect the website, our business or other users.


25. INTELLECTUAL PROPERTY

Unless otherwise stated, the content of the Boon website and materials created by Boon are owned by or licensed to Boon.

This includes, where applicable:

  • the BOON name and identity;

  • logos and trademarks;

  • photography;

  • films;

  • graphics;

  • copy;

  • illustrations;

  • product designs;

  • drawings;

  • specifications;

  • kitchen and furniture designs;

  • design details;

  • renders;

  • layouts; and

  • other creative material.

You may view website content for your personal, non-commercial use.

You may not reproduce, distribute, commercially exploit, modify, publish or create derivative works from our content without our prior written permission, except where permitted by law.

Unless otherwise agreed in writing, providing drawings, renders or design materials to a client does not transfer Boon's intellectual property rights in those materials.


26. AI, AUTOMATED SYSTEMS & DATA EXTRACTION

Except where permitted by law or expressly authorised by us in writing, you may not use automated systems to systematically scrape, extract or reproduce substantial parts of our website or proprietary content.

You may not use Boon's proprietary drawings, renders, photography, designs or other protected creative materials to train or develop an artificial intelligence model or dataset without our prior written permission, except to the extent such use cannot lawfully be restricted.

Nothing in this section is intended to prevent ordinary consumer use of browser, accessibility, search or shopping tools that access the website lawfully and do not circumvent our technical protections.


27. THIRD-PARTY LINKS & SERVICES

Our website may contain links to third-party websites or services.

We do not control those websites and are not responsible for their content, availability or separate terms and privacy practices.

Where you purchase directly from a third party, your contract with that third party will be subject to its own terms.


28. SHOPIFY

Our online store is hosted by Shopify.

Shopify provides the ecommerce technology through which we make certain products and services available.

Any contract for goods or services purchased directly from Boon is between you and Boon, not Shopify.

Shopify's processing of personal information is governed by the relevant Shopify privacy terms and our Privacy Policy.


29. PRIVACY

Our collection and use of personal information is described in our Privacy Policy.

Because our online store is hosted by Shopify, certain personal information may also be processed by Shopify and relevant service providers in order to operate the website, process transactions and provide ecommerce functionality.

30. FEEDBACK, REVIEWS & USER CONTENT

If you submit a review, photograph, comment or other content to us or through our website, you confirm that you have the right to provide that material.

Where you submit content for publication, you grant Boon a non-exclusive, worldwide, royalty-free licence to reproduce and display that content for the purpose for which it was submitted, including displaying customer reviews or project feedback.

We will not claim ownership of your content.

We may remove content from our website where we reasonably believe it is unlawful, misleading, infringing, abusive or otherwise inappropriate.


31. ERRORS & OMISSIONS

We take reasonable care to ensure our quotes, invoices, drawings, specifications and website information are accurate.

Occasionally, genuine errors or omissions may occur.

Where we identify an obvious error in pricing, specification or description, we will notify you as soon as reasonably possible and seek to correct it.

Where an error materially affects an order that has not yet been fulfilled, we may offer you the choice of proceeding on the corrected basis or cancelling the affected part of the order for a refund.

Nothing in this section limits your statutory rights.


PART D — GENERAL TERMS

32. EVENTS OUTSIDE OUR CONTROL

We will not be responsible for delay or failure to perform an obligation where this results from circumstances outside our reasonable control.

These may include severe weather, fire, flood, industrial action, transport disruption, supplier failure, material shortages, government action or other comparable events.

Where such an event materially affects your project, we will contact you and take reasonable steps to minimise the impact.

This section does not affect any rights you have under applicable consumer law.


33. LIABILITY

Nothing in these Terms excludes or limits liability where it would be unlawful to do so.

In particular, nothing in these Terms limits your statutory rights as a consumer or excludes liability that cannot legally be excluded.

We are not responsible for losses that are not a reasonably foreseeable result of our breach of these Terms or failure to exercise reasonable care and skill.

Where you are purchasing as a consumer, we are not responsible for business losses arising from the use of goods or services supplied primarily for domestic and private purposes.


34. OWNERSHIP OF GOODS

Where permitted by law, ownership of goods supplied as part of a commissioned project remains with Boon until we have received payment in full for those goods.

Risk and responsibility for goods are dealt with separately under the delivery provisions above and applicable law.


35. THIRD-PARTY TRADES

Where Boon coordinates with architects, contractors, electricians, plumbers, builders, decorators, stone fabricators or other independent third parties, those parties remain responsible for their own work unless they have been directly engaged by Boon as our subcontractor.

Boon is not responsible for defects or delays caused by independent contractors appointed directly by you.


36. COMMUNICATION & APPROVALS

Where these Terms require something to be agreed or confirmed in writing, this may include email or another written project communication method agreed between us.

You are responsible for ensuring that the person giving instructions or approvals on your behalf is authorised to do so.

We may reasonably rely upon instructions and approvals given by an authorised client representative.


37. SEVERABILITY

If any provision of these Terms is found to be unlawful or unenforceable, that provision will be treated as modified or removed to the minimum extent necessary.

The remaining provisions will continue to apply.


38. WAIVER

If either party does not immediately enforce a right under these Terms, that does not mean that right has been waived.


39. CHANGES TO THESE WEBSITE TERMS

We may update these Terms from time to time.

The latest version will be published on this page with the date on which it was last updated.

Changes to website terms will not retrospectively alter the terms of an existing commissioned project unless agreed with you or required by law.


40. GOVERNING LAW

These Terms and any contract between you and Boon are governed by the laws of England and Wales, unless applicable consumer law requires otherwise.

If you are a consumer resident elsewhere in the United Kingdom, you may also have rights to bring proceedings in the courts applicable to where you live.


41. ACCEPTANCE

For commissioned projects, you accept the applicable Terms by approving the quote, paying the relevant deposit, approving drawings or otherwise expressly instructing Boon to proceed after these Terms have been made available to you.

For online purchases, the applicable Terms form part of the contract when your order is accepted.
